Terms and Conditions

1. Service Overview

unofax (“the Service,” “we,” “us,” or “our”) provides an internet-based fax transmission service operated by AWS, CYY & Co. Pty Ltd (ACN 686 116 245) as Trustee for Mumu, Lulu & Co. (ABN 54 837 123 965) via unofax.com. The Service enables users (“you” or “the Customer”) to upload digital documents and transmit them as faxes to telephone numbers in supported destination countries worldwide. The Service is operated from Melbourne, Australia. unofax is not a telecommunications carrier or carriage service provider. Fax transmission is carried out by GoFax Pty Ltd (ABN 24 092 744 571), a carriage service provider.

The liability of the Trustee is limited to the assets of the trust known as Mumu, Lulu & Co. from time to time. No party may seek to recover from the Trustee personally or from the directors of the Trustee in their personal capacity.

2. Definitions

Business Day means Monday to Friday, excluding Australian public holidays and days affected by Force Majeure events.

Content means any data, documents, images, text, or other materials uploaded by the Customer for transmission.

Cover Sheet means the optional fax cover page generated by the Service at no additional charge.

Fees means the charges for the Service as displayed on the website at the time of transaction, denominated in Australian Dollars (AUD).

Force Majeure means any event beyond the reasonable control of either party, including but not limited to natural disasters, acts of war or terrorism, pandemics, government actions, telecommunications failures, power outages, or interruptions to internet infrastructure.

Supported Destinations means the countries and regions listed on our website to which fax transmissions may be sent, excluding any subdestinations identified as unsupported.

Transmission means the process of converting and delivering a document via the fax protocol (T.38/T.30) to a recipient fax machine or service.

3. Acceptance of Terms

By accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. Each use of the Service constitutes a renewed acceptance of these Terms as they exist at the time of use.

4. Eligibility

The Service is available to individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

The Service is intended for lawful business and personal use. You must not use the Service on behalf of any entity unless you are duly authorised to bind that entity to these Terms.

5. Service Description and Delivery

The Service operates on a self-service, pay-per-use basis. No account registration, subscription, or ongoing commitment is required.

To use the Service, you must: (a) upload a document in a supported file format (see Section 6 for the full list); (b) enter a valid fax number in a Supported Destination; and (c) complete payment. Upon successful payment, the Service will attempt to transmit your document to the specified fax number.

Transmission is initiated immediately after payment processing. Delivery times depend on the recipient’s fax machine, telephone network conditions, document size, and other factors beyond our control. Most single-page faxes are delivered within one to three minutes.

A delivery confirmation or failure notification will be provided to you via the Service interface. We do not guarantee delivery to any specific fax number, as delivery depends on the recipient’s equipment and telecommunications infrastructure being operational and capable of receiving fax transmissions.

You acknowledge that processing and transmission begin immediately upon payment confirmation. To the extent permitted by applicable law, you waive any statutory right of withdrawal or cooling-off period once processing has commenced.

For scheduled faxes, payment is collected at the time of booking. The fax is queued for the scheduled send time, and delivery is subject to system availability at the scheduled time. Scheduled faxes are subject to the same delivery confirmation, failure notification, and refund terms as immediate transmissions.

By providing your email address and completing payment, you consent to receiving transactional email communications related to your fax transmission, including delivery confirmations, failure notifications, and refund notices.

6. Service Limitations

The following technical limitations apply to each transmission:

Maximum file size: 100 MB per upload
Maximum page count: 300 A4 pages per transmission
Supported file formats: PDF, DOC, DOCX, PNG, JPG, JPEG, GIF, WebP, HEIC, HEIF, TIF, TIFF
Supported destinations: As listed on our website; certain subdestinations (premium-rate, VoIP, personal numbering, and NGN numbers) may be excluded
Paper format: All documents are converted and transmitted in A4 format

We reserve the right to reject or cancel any transmission that exceeds these limitations or that we reasonably determine may cause harm to our systems or third-party infrastructure.

7. Pricing and Payment

The Service is priced on a flat-rate, per-page basis. The applicable rate is displayed on the website and at the point of payment. All prices are stated and charged in Australian Dollars (AUD) and are inclusive of Australian Goods and Services Tax (GST). Currency conversion, if applicable, is performed by your card issuer at their prevailing exchange rate and is outside our control. Any approximate local currency equivalents displayed on the website are provided for informational purposes only, are based on indicative exchange rates at the time of publication, and do not constitute a guarantee of the final amount charged. The actual amount debited in your local currency may differ.

We accept Visa, Mastercard, American Express, Apple Pay, and Google Pay. Payment processing services for orders placed through the Service are provided by Square. All card payments are processed securely by Square, a PCI DSS Level 1 certified payment processor. By placing an order and using Square to process payments, you agree to be bound by Square’s General Terms of Service, Privacy Policy, and Buyer Terms (collectively, the “Square Services Agreement”), which may be modified by Square from time to time. You consent to Square’s collection and use of your information as described in their Privacy Policy. As a condition of enabling payment processing services through Square, you agree to provide us with accurate and complete information, and you authorise us to share that information and transaction information related to your use of the payment processing services with Square. We do not store, access, or process your full card details at any time.

The total cost of a transmission is calculated after your document is converted and the actual page count is determined. An estimate is provided before payment, but the final charge is based on the actual number of rendered pages. You will have the opportunity to review the final cost and a preview of the rendered fax before confirming payment.

Prices may be updated from time to time. The price applicable to your transaction is the price displayed at the time of payment.

8. Refund Policy

If a fax transmission fails to deliver (i.e., the recipient’s fax machine does not successfully receive the transmission), you are entitled to a full refund of the amount charged for that transmission. Refunds are processed automatically to the original payment method and typically appear within 5–10 business days, depending on your card issuer.

Refunds are not available in the following circumstances:

• The fax was successfully delivered but you entered an incorrect fax number
• The fax was successfully delivered but you transmitted the wrong document
• You change your mind after a successful delivery (“sender’s remorse”)
• The recipient’s fax machine received the transmission but produced poor print quality due to the recipient’s equipment

Billing disputes must be raised within 30 calendar days of the transaction date by contacting us at support@unofax.com. We will investigate all disputes in good faith and respond within 10 Business Days.

For scheduled faxes, you may cancel at any time before the scheduled send time through the Service interface. If a scheduled fax is cancelled before the scheduled send time, a full refund will be issued. Once transmission begins, the standard refund policy above applies.

Chargebacks: If you believe a charge is incorrect, you must contact us at support@unofax.com before initiating a chargeback (payment dispute) with your card issuer. We are committed to resolving billing issues promptly and will process legitimate refunds within 1 Business Day. If you initiate a chargeback without first contacting us, or if a chargeback is found to be unsubstantiated (for example, because the fax was successfully delivered, or a refund was already issued or available through our refund process), you agree to reimburse unofax for all fees and administrative costs incurred as a result of the chargeback process, up to a maximum of AUD $25 per chargeback. We reserve the right to recover these costs by any lawful means, including by setting off the amount against any refund otherwise due to you. Nothing in this clause limits your rights under the Australian Consumer Law or any applicable consumer protection legislation, including your right to lodge a complaint with the ACCC or a state or territory consumer affairs agency.

9. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. Without limitation, you must not use the Service to:

• Send unsolicited faxes, advertisements, or promotional material (spam or “junk fax”)
• Transmit content that is illegal, defamatory, obscene, threatening, abusive, harassing, or otherwise objectionable
• Transmit content that infringes any third party’s intellectual property rights, privacy rights, or other legal rights
• Transmit content that violates applicable anti-spam, telemarketing, or consumer protection legislation in any jurisdiction, including but not limited to the Australian Spam Act 2003, the US Telephone Consumer Protection Act (TCPA), or equivalent laws
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorised access to our systems, interfere with the operation of the Service, or circumvent any security measures
• Use the Service in any manner that could damage, disable, or impair the Service or interfere with any other party’s use of the Service

We reserve the right to refuse, suspend, or terminate your access to the Service immediately and without notice if we reasonably believe you have violated this Acceptable Use Policy.

10. Customer Responsibilities and Warranties

You represent and warrant that:

• All information you provide (including fax numbers and document content) is accurate and complete
• You have the legal right and authority to transmit the Content you upload
• Your use of the Service complies with all applicable laws and regulations in your jurisdiction and the recipient’s jurisdiction
• You have obtained all necessary consents, permissions, and licences required to transmit the Content to the intended recipient
• The Content does not contain any viruses, malware, or other harmful code
• All information entered on the cover sheet (if used) is accurate and you accept responsibility for its content

You are solely responsible for verifying the accuracy of the recipient fax number before submitting a transmission. We bear no responsibility for transmissions sent to incorrect numbers due to customer error.

You are solely liable for any consequences arising from inaccurate, misleading, or fraudulent sender identification entered on the cover sheet, including but not limited to impersonation of another person or entity. unofax does not verify the accuracy of cover sheet information and accepts no responsibility for claims, losses, or legal action resulting from your use of the cover sheet feature.

11. Intellectual Property

All intellectual property rights in the Service, including but not limited to the website design, user interface, software, logos, trademarks, and documentation, are owned by or licensed to unofax and are protected by applicable intellectual property laws.

You retain ownership of all Content you upload. By uploading Content, you grant us a limited, temporary licence to process, convert, transmit, and share that Content with our service providers solely for the purpose of fulfilling your fax transmission request. This licence terminates automatically upon deletion of the Content in accordance with our document handling practices.

12. Document Handling and Data Security

We take the security and confidentiality of your documents seriously. The following practices apply:

• All documents are encrypted in transit using TLS and at rest using AES-256 encryption
• Uploaded documents are stored temporarily in secure cloud infrastructure (Amazon Web Services, Sydney region) solely for the purpose of conversion and transmission
• Fax transmission is carried out by GoFax Pty Ltd (ABN 24 092 744 571), an Australian-owned fax gateway provider. GoFax is ISO 27001 certified and HIPAA compliant. Your document content, recipient fax number, and sender identification (email address) are shared with GoFax solely for the purpose of completing the transmission. Documents are processed automatically by our systems. No human at unofax reads, reviews, or manually accesses the content of your documents unless required by law, legal process, or to resolve a billing dispute or support request you have initiated. • Documents are automatically and permanently deleted 7 days after transmission or attempted transmission, regardless of whether delivery succeeded or failed. Transaction metadata is retained for up to 100 days after transmission to allow for billing dispute resolution and to accommodate chargeback windows imposed by payment card networks

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) any fax transmission will be successfully delivered to the intended recipient; or (d) any defects in the Service will be corrected.

We are not responsible for the performance, reliability, or availability of third-party telecommunications networks, internet service providers, or recipient fax equipment.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNOFAX, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount paid by you to unofax in the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred Australian Dollars (AUD $100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, death, or personal injury caused by negligence, or any liability under the Australian Consumer Law that cannot be excluded.

15. Indemnification

You agree to indemnify, defend, and hold harmless unofax and its officers, directors, employees, agents, and affiliates from and against any third-party claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• The Content you transmit through the Service, including any claims of defamation, intellectual property infringement, or illegality
• Your use of the cover sheet feature to misrepresent your identity or the identity of any person or entity
• Your violation of any applicable anti-spam, telemarketing, or consumer protection law in connection with your use of the Service

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from a Force Majeure event. In such circumstances, our obligations shall be suspended for the duration of the Force Majeure event. We will use reasonable endeavours to mitigate the effects of any Force Majeure event and to resume performance as soon as practicable.

17. Modifications to Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. We will provide at least 14 days’ notice of material changes by updating the “Last updated” date at the top of this page and posting a summary of changes on our website. It is your responsibility to review these Terms periodically.

Your continued use of the Service following the posting of any changes constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue your use of the Service.

18. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

The failure of unofax to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of unofax.

Survival: The following sections shall survive the termination or expiration of these Terms: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Entire Agreement, and Governing Law and Jurisdiction.

19. Assignment

We may assign or transfer our rights and obligations under these Terms to any successor entity, affiliate, or purchaser of all or substantially all of our assets, without your prior consent. In the event of such assignment, we will notify you by updating these Terms or by posting a notice on our website. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

20. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and unofax with respect to your use of the Service. They supersede all prior or contemporaneous communications, proposals, representations, understandings, and agreements, whether oral or written. Between you and unofax relating to the subject matter hereof.

No statement, representation, warranty, or undertaking made by unofax in any marketing material, support correspondence, or other communication shall form part of these Terms unless expressly incorporated herein or displayed on the website at the point of transaction.

These Terms are drafted in English. In the event of any conflict between a translated version of these Terms and the English version, the English version shall prevail.

21. Dispute Resolution

If a dispute arises out of or in connection with these Terms or the Service, the parties agree to follow this stepped process before commencing court proceedings:

Step 1: Informal Resolution: You must first contact us at support@unofax.com with a written description of your complaint. We will endeavour to resolve the matter within 10 Business Days of receipt.

Step 2: Mediation: If the dispute is not resolved informally within 20 Business Days of the date unofax receives your written complaint, either party may refer the dispute to mediation administered by the Resolution Institute (or its successor body) in accordance with its mediation rules then in effect. The mediation will take place in Melbourne, Victoria, unless the parties agree otherwise. For claims where the amount in dispute is less than AUD $500, unofax will bear the costs of mediation. For all other claims, the costs of mediation will be shared equally between the parties. In all cases, each party will bear its own legal costs.

Step 3: Court Proceedings: If the dispute is not resolved within 30 Business Days of the mediation commencing (or if mediation is declined by either party), either party may commence court proceedings in accordance with Section 22 (Governing Law and Jurisdiction).

Nothing in this clause prevents either party from seeking urgent interlocutory or injunctive relief from a court of competent jurisdiction at any time. Nothing in this clause prevents you from lodging a claim with the Victorian Civil and Administrative Tribunal (VCAT) or any equivalent tribunal in your jurisdiction. This dispute resolution process does not limit any rights you may have under the Australian Consumer Law or equivalent consumer protection legislation to lodge a complaint with a relevant regulatory body, including the Australian Competition and Consumer Commission (ACCC) or a state or territory consumer affairs agency.

22. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of the State of Victoria and the Federal Court of Australia sitting in Victoria for the resolution of any disputes arising out of or in connection with these Terms or the Service.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded by agreement.
